Terms

  1. "Finca Flamenco" or "Finca Flamenco Holiday Suites": the holiday accommodation at Los Malagueños 22, 29560 PIZARRA Andalusia, Spain.

  2. "Tenant": the natural person who reserves and/or rents (a part of) Villa Flamenco for themselves and possibly others in their name.

  3. "Landlord": the owners of "Finca Flamenco".

Algemeen

The tenant who enters into the rental agreement is liable for all payments.

The suites/rooms must be inhabited by the tenant and their companions/guests with due care, respecting the peace and quiet of the surroundings

Tenant Age Policy

Only individuals aged 18 years and older can rent a stay with us. When making a reservation and during check-in, each guest must be able to identify themselves with a valid ID or passport, demonstrating that they are 18 years or older. We reserve the right to request identification in case of doubt and to refuse entry to individuals who do not meet this requirement.

Deviation from Tenant Age Policy by Landlord

Landlords have the right to deviate from the age policy, for example, in situations where family members or friends stay with individuals under 18 years of age.

Reservations

A request for a reservation can be made:

 

The tenant indicates the period for which they want to make a reservation. They also specify which room of Finca Flamenco they want to rent. By making a reservation, the tenant implicitly confirms that they have read, understood, and agreed to the terms and privacy policy of the landlord.

The landlord then sends the tenant a confirmation of the reservation by email, after checking availability. This email includes, among other things, an overview of the amounts to be paid by the tenant, the associated deadlines, and the landlord's IBAN number.

The landlord then receives from the tenant:

  • a copy of their valid passport (or equivalent valid identity document), without BSN or any other identification number

  • ztheir mobile number and email address (if not already known).

Only after the agreed amounts have been transferred by the tenant to the landlord's account, there is a binding rental agreement. Until then, the landlord can cancel the reservation without giving any reason. They will immediately refund any amounts already paid.

Payments

The tenant must transfer a deposit of 50% of the rental price to the landlord’s account. If the stay is scheduled within 60 days of booking, the deposit must be paid within 7 days of receiving the confirmation email. However, if the stay is scheduled more than 60 days after booking, the deposit must be paid 60 days before arrival. The tenant must clearly mention the relevant confirmation number and rental period when making the payment.

The total amount due must be credited to the landlord’s account no later than 14 calendar days before the start of the stay. If this is not the case, the outstanding amount can be paid in cash or by debit/credit card upon arrival or departure.

 

Not timely payment

If the tenant fails to pay on time, the landlord considers this as cancellation of the rental by the tenant, and the rental agreement is terminated immediately.

 

Cancellation by Tenant

Sometimes it may be necessary to cancel your booking. There are often costs associated with this. In many cases, you can avoid these costs by taking out cancellation insurance on time.

The tenant can only cancel by sending an email to info@finca-flamenco.com. In this email, they should mention the booking number and the reason for cancellation.

If the tenant has booked a non-refundable rate, they are not eligible for any refund. In all other cases, the landlord will refund:

  • 100% of the costs if the tenant cancels the booking via the mentioned email within 48 hours of making the booking.

  • 100% of the costs if the tenant cancels more than 60 calendar days before the check-in date.

  • 50% refund of costs for cancellation between 30 and 60 calendar days before the check-in date.

  • 25% refund of costs for cancellation between 14 and 30 calendar days before the check-in date.

In other cases, the landlord is not obligated to provide any refund. Even in the event of early departure, the landlord is not obligated to provide any refund.

 

No-show

A "no-show" occurs when the tenant does NOT physically appear at the address of "Finca Flamenco" or its representative on the agreed check-in date and time, and the tenant has not informed the landlord in a timely manner about any possible delay. The landlord considers a no-show as cancellation of the rental by the tenant, resulting in the immediate termination of the rental agreement.

 

Cancellation by Landlord

If the landlord needs to cancel the rental due to unforeseen circumstances and unilaterally terminates the rental agreement, the tenant will be immediately informed via email, and any payments made by the tenant will be refunded by the landlord within 7 days.

Damage, Loss, and/or Theft of Tenant's Property

The landlord is not liable for any damage, loss, or theft of the tenant's property, co-tenants, and/or any guests. In case of disputes, all (legal) costs will be borne by the tenant.

 

Damage

The tenant is liable for all damage caused by themselves, co-tenants, and/or any guests. Even if damage is discovered after leaving the property. All risks related to staying at "Finca Flamenco" are borne by the tenant.

The tenant must immediately report all damage and/or missing items in "Finca Flamenco" to the landlord. This can be done via WhatsApp or email.

The tenant reimburses the landlord for the damaged and/or missing item(s) within 7 days after departure based on the replacement value in euros. The age of the relevant item(s) is not taken into account. The landlord will send the tenant an invoice for the relevant costs.

Pets

Pets, other than those belonging to the landlord, are not allowed in Finca Flamenco (except certified assistance animals).

 

Check-in and Check-out
Every guest must present a valid ID or passport upon check-in.

Check-in is from 14:00 to 23:00 on the day of arrival.

Check-out is before 11:00 on the day of departure.

Arrivals after 23:00 and before 11:00 must be agreed upon and confirmed by email or WhatsApp at least 24 hours before arrival.

Guests have the option to arrive earlier or depart later than the standard check-in and check-out times, but they will not have access to their accommodation. However, they can still use the shared facilities such as the pool and terraces.

Responsibility

The landlord cannot be held liable for disturbances or inconveniences during the stay in the holiday home if they result from unforeseen events. The landlord cannot be held liable for inconveniences caused by the work of third parties, such as the municipality, province, etc. Likewise, the landlord cannot be held liable for interruptions in water, electricity, and internet if they result from force majeure.

The landlord disclaims any responsibility for loss, theft, or damage to luggage, personal belongings, or vehicles, and for costs resulting from not reaching the holiday home on time. The landlord cannot be held liable for accidents.

 

Complaints and Disputes

A complaint about the holiday home will only be processed if it is reported to the landlord within 24 hours of using the holiday home. These (urgent) reports must be made to the landlord by phone, followed by a confirmation email to service@finca-flamenco.com. The same rule applies if something serious happens during your stay in the holiday home. If it is not possible to reach an agreement, the tenant must have the complaint verified by an expert, bailiff, or notary to obtain an objective assessment.

 

Keys

Upon check-in, guests receive keys to Finca Flamenco, which they return upon check-out. Guests are all responsible for properly locking both the front door and the entrance gate of Finca Flamenco. If one or more keys are missing upon check-out, the landlord will replace the corresponding cylinders at the expense of the tenant. The tenant will receive an invoice for the actual costs, which must be paid to the landlord within 7 calendar days.

 

Additionally, the following house rules apply:

  • Pets are not allowed (except for certified assistance animals).

  • Smoking is not permitted inside the house, around the pool area, and in the garden (fire hazard). Smoking is only allowed on the open terrace and patio (ashtrays are available).

  • Although the house is very private, we do have neighbors. Please respect the 'quiet hours' between 00:00 and 08:00.

  • The pool may be used between 08:00 and 21:00 (April - October) and between 10:00 and 18:00 (November - March).

  • Open fires or (large) barbecues are not permitted (both indoors and outdoors). The outdoor kitchen and associated BBQ are free to use.

  • Visitors (individuals other than guests registered by the landlord) may only stay overnight in Finca Flamenco with the landlord's approval.

  • Commercial events or noisy parties are not allowed in Finca Flamenco without written permission from the landlord.

  • Commercial photography or filming without written permission from the landlord is strictly prohibited.

Privacy policy

Finca Flamenco processes your personal data because you use our services and/or because you provide them to us yourself. Below you will find an overview of the personal data we process:

  • Identity card or passport details (without citizen service number), due to mandatory tourist registration in Spain

  • Address

  • Phone number

  • Email address

  • Bank account number

 

We process your personal data for the following purposes:

  • To process payments and prevent fraud

  • To comply with legal obligations, such as tax returns and tourist registration

  • To communicate with you

  • To respond to your requests, complaints, or feedback

  • To improve our services

 

We will not retain your personal data for longer than strictly necessary. We adhere to the following retention periods for personal data:

  • Personal data - 5-year retention period - Tax authorities

  • Address - 5-year retention period - Tax authorities

  • Contact form - 5-year retention period - Maintaining communication

 

Finca Flamenco does not sell your data to third parties and only provides it if necessary for the execution of our agreement with you or to comply with a legal obligation.

Our website only uses technical and functional cookies. A cookie is a small text file that is stored on your computer, tablet, or smartphone when you first visit this website. The cookies we use are necessary for the technical operation of the website and your convenience. They ensure that the website works properly and remember your preferences, for example. It also allows us to optimize our website. You can opt-out of cookies by setting your internet browser to not store cookies anymore. Additionally, you can also delete any information previously stored via your browser settings.
